Tutor Licence
1. Our relationship with tutors
1.1 We are an employment agency, regulated by the United Kingdom Employment Agencies Act 1973
1.2 We do not have authority to act as agents for our clients in making contracts with you.
1.3 Our service is intended to help our clients engage tutors as well as a provide a platform that will allow them to use other services, as part of the intermediary services SOTC supplies to the client, if they wish to do so. For example, Twilio for communications, Lessonspace for having and recording online classes, and Stripe as a payment processor for those classes.
1.4 In particular, we do not offer to find you work. You are welcome to use our platform if, in doing so, you do not break any of the terms of this licence, but our relationship with you is not contractual. In other words, you do not owe us any contractual duties; nor do we owe you any.
1.5 If you agree to an engagement by one of our clients, it will be on terms you agree with them.
1.6 We will, if requested by a client, try to help the client resolve any dispute they may have with you about the services you provided, but the best we can do is mediate.
1.7 In particular, we are not responsible for payment. Our customers can use the Stripe payment service, which may have some facilities for dispute resolution (for which you must consult their terms), but we have no control over whether these payments are made so that any dispute about payment will be between you and the client.
1.8 Since our relationship is not contractual, we have absolute discretion as to whether to admit you as a tutor or to permit you to continue to use the platform. Nothing in this licence should be construed as any promise by us to act in a particular way.
2. Listing
2.1 We may suspend the listing of tutors (which may include their access to the platform or any part of it), for a period of time or indefinitely, for any lawful reason, without explanation, if we choose to do so. If we do choose to explain why we have suspended a tutor, we make no guarantee that we will do so on any subsequent occasion.
2.2 Suspension does not indicate that you have done anything wrong. We may, for example, have too many of a particular class of tutor, or have decided not to offer a particular subject area.
3. Licence conditions
3.1 We permit you to use the platform on the following conditions:
3.1.1 You do not breach the "code of conduct".
3.1.2 You do not act in a way that is unprofessional, for example by failing to make every effort to attend classes, or failing to explain your absence to a client.
3.1.3 You do not use the platform to commit fraud, for example by claiming fees to which you are not entitled.
4. Evidence
4.1 We will routinely ask prospective tutors to provide us with evidence we believe is necessary to determine whether they are suitable for, or meet the requirements of, our clients. For example, we will routinely ask for evidence supporting an enhanced disclosure or the non-UK equivalent and professional references.
